By accessing or using Z-Scope PRO ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

1.Definitions

"Service" means the Z-Scope PRO web application, dashboard, and all related features accessible at zscope.org. "User" means any individual who accesses or uses the Service. "Content" means all data, analyses, scores, alerts, AI-generated text, and other information displayed within the Service. "Operator" means the individual identified above.

2.Nature of the Service

Z-Scope PRO is a cryptocurrency market data aggregation and intelligence dashboard. It provides informational and educational content only. The Service does not constitute financial, investment, tax, or legal advice. The Service does not execute trades, hold or manage funds, or act as a broker, exchange, custodian, or financial intermediary of any kind.

The Operator is not a regulated financial services provider and is not authorized under Directive 2014/65/EU (MiFID II), the Czech Capital Market Undertakings Act (No. 256/2004 Coll.), or any equivalent legislation. The Service does not provide investment services, investment advice, portfolio management, reception and transmission of orders, or any other regulated activity within the meaning of MiFID II or applicable national law.

3.No Investment Advice — Risk Warning

All Content — including AI-generated analyses, alerts, confluence signals, edge scores, and market summaries — is for informational and educational purposes only and must not be construed as a recommendation to buy, sell, or hold any cryptocurrency or financial instrument.

Cryptocurrency markets are highly volatile and you may lose all of your invested capital. Cryptocurrencies are not legal tender in most jurisdictions, are not insured by any deposit protection scheme, and may experience extreme price movements within short timeframes. Leveraged or derivative cryptocurrency products carry additional risks, including the possibility of losing more than your initial deposit.

You acknowledge that all investment and trading decisions are made at your sole risk and discretion. Past performance data shown on the platform is not indicative of future results. You should consult a qualified, licensed financial advisor before making any investment decision.

4.Eligibility and Geographic Restrictions

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

The Service is not available to residents of, or persons located in, jurisdictions where its provision would violate local law or regulatory requirements, including but not limited to:

the United States of America (and its territories);
the People's Republic of China (excluding Hong Kong SAR);
the Republic of Korea (South Korea);
the Russian Federation;
any jurisdiction subject to comprehensive sanctions by the European Union, the United Nations, or the Czech Republic.

By using the Service, you represent that you are not located in, a resident of, or a citizen subject to the jurisdiction of any such country. The Operator reserves the right to block access from, or terminate accounts of, users in restricted jurisdictions. You are solely responsible for ensuring that your use of the Service complies with all laws and regulations applicable to you.

5.User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information during registration and to notify us immediately of any unauthorized access or security breach. The Operator reserves the right to suspend or terminate accounts that violate these Terms.

6.Acceptable Use

You agree not to:

(a) reverse-engineer, decompile, scrape, crawl, or redistribute any data, code, or content from the Service, except where such collection is performed by the Operator from third-party data providers under their published API terms or RSS feed licenses;

(b) use the Service for any unlawful purpose or in violation of any applicable laws;

(d) resell, sublicense, or commercially exploit access to the Service without prior written consent;

(e) use automated tools (bots, scripts) to access the Service in a manner that exceeds reasonable personal use;

(f) interfere with or disrupt the Service or impose an unreasonable load on infrastructure;

(g) extract, store, or republish substantial portions of market data displayed via the Service for commercial purposes.

7.Intellectual Property

All intellectual property rights in the Service (including design, code, branding, and proprietary algorithms) belong to the Operator. Market data displayed within the Service is provided by third-party sources and is subject to those providers' respective terms. You retain ownership of any data you input into the Service (portfolio, watchlist, notes, journal entries).

Users may not extract, store, or republish substantial portions of market data displayed via the Service for commercial purposes. Personal, non-commercial use of the displayed data within reasonable limits is permitted.

8.Third-Party Data and Services

The Service aggregates data from third-party providers and integrates with third-party services, including but not limited to:

Market data: CoinGecko, Binance, DeFiLlama, Alternative.me, RSS feeds from public news sources
Infrastructure: Supabase (database, authentication; data hosted in the European Union), Hetzner (server hosting, EU)
Payments: Stripe (PCI-DSS compliant, processes card data outside the Operator's systems)
AI processing: Anthropic (Claude API; data may be processed in the United States under EU Standard Contractual Clauses)
Notifications: Telegram (where you opt in to alerts)

The Operator does not control, verify, guarantee, or assume responsibility for the accuracy, completeness, reliability, or timeliness of third-party data. Third-party services are subject to their own terms and privacy policies. Links to external websites are provided for convenience only and do not imply endorsement.

9.AI-Generated Content

AI-generated content (market briefs, analyses, scores, alerts) is produced by third-party large language models and algorithmic processing. Such content may contain errors, inaccuracies, outdated information, or biases.

AI-generated content reflects historical patterns and training data and may not account for breaking news, market manipulation, regulatory actions, or other emerging events. The accuracy, completeness, or timeliness of AI outputs is not guaranteed.

AI-generated content does not reflect the personal views or recommendations of the Operator. It should be treated as one of many data points and must not be relied upon as the sole basis for any financial or investment decision.

10.Subscriptions and Payments

Paid subscriptions are billed on a recurring basis (monthly or annually, as selected). All payments are processed by Stripe. The Operator does not store or have access to your payment card details.

Auto-renewal: Subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled. The Operator will send a renewal reminder by email at least 7 days before each billing cycle.

Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access until the end of your current billing period. No partial refunds are issued for unused portions of a billing cycle, except as required by mandatory consumer protection law (see "EU consumer rights" below).

Price changes: Prices may change with at least 30 days' prior notice by email. If you do not accept the new price, you may cancel before the effective date without penalty.

EU consumer rights: EU/EEA consumers have a 14-day right of withdrawal under Directive 2011/83/EU. Detailed conditions, including the digital-content waiver provided for in Article 16(m), are described in the Refund Policy.

11.Limitation of Liability

To the maximum extent permitted by applicable law, the Operator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or relating to:

(a) your use of, or inability to use, the Service;

(b) any trading or investment decisions made based on Content provided by the Service;

(d) unauthorized access to or alteration of your data;

(e) any interruption or cessation of the Service.

In jurisdictions that do not allow exclusion of certain warranties or limitation of liability, the Operator's liability is limited to the maximum extent permitted by law. In no event shall the Operator's total aggregate liability exceed the amount you paid for the Service in the 12 months preceding the claim, or EUR 100, whichever is greater.

Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, death, or personal injury, or for any other liability that cannot be limited under applicable mandatory law.

12.Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. The Operator does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

13.Indemnification

You agree to indemnify and hold harmless the Operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

(a) your use of the Service;

(b) your violation of these Terms;

(d) any trading or investment decisions you make.

14.Termination

The Operator may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

If your subscription is terminated by the Operator without cause, you will receive a pro-rated refund for the unused portion of your current billing period. No refund is due if termination is due to your violation of these Terms.

Provisions that by their nature should survive termination (including Limitation of Liability, Disclaimer of Warranties, Indemnification, and Governing Law) shall survive.

15.Modifications to Terms

The Operator reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Your continued use of the Service after the effective date of modified Terms constitutes acceptance.

If you do not agree to the modified Terms, you may cancel your subscription before the effective date and receive a pro-rated refund for any unused portion of the current billing period. Non-material changes (e.g., typo corrections, clarifications that do not affect your rights) take effect immediately upon posting.

16.Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17.Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to conflict of law principles.

Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service, including the existence, validity, or termination thereof, shall be finally settled by arbitration administered by the Arbitration Court attached to the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic in Prague, in accordance with its Rules. The arbitration shall be conducted by a sole arbitrator, in English, with the seat of arbitration in Prague, Czech Republic.

Consumer exception: If you are a consumer in the EU/EEA, nothing in this Section limits your right to bring proceedings before the courts of your country of residence under mandatory consumer protection laws, nor your right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

18.Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and the Operator regarding the Service and supersede all prior agreements and understandings.
